Reports and Recommendations of the City Manager
1.

Approval is recommended to enter into a price agreement (198-09) with Blue Valley Public Safety, for maintenance for outdoor warning sirens at various locations within the City for the period January 21, 2009, through December 31, 2009.  Expenditures will not exceed budgeted amounts.



2.

Approval is recommended to enter into a price agreement (160-09) with the Victor L. Phillips Co., for OEM Vibrastat Roller Parts, OEM Case Parts and Coates Snowplow Parts for the period of February 1, 2009, through January 31, 2010, with two, one-year renewal options.  Expenditures will not exceed budgeted amounts.



3.

Approval is recommended to enter into a Price Agreement (187-09) with Universal Lubricants Inc., for petroleum products for the period of April 1, 2009, through March 31, 2010.  Expenditures will not exceed budgeted amounts.



4.

Approval is recommended to enter into a price agreement (200-08) with Penney's Concrete, for ready-mix concrete for various departments for the period February 1, 2009, through January 31, 2010, with two, one-year renewal options.  Expenditures will not exceed budgeted amounts.




Resolutions:

08-791 - A resolution approving the amended Preliminary Plat of Freedom Landing, a 15-lot mixed use subdivision located north of R. D. Mize Road between Necessary Road and the future Little Blue Parkway, Case No. 08-310-03. Deferred to February 2, 2009 meeting.



09-701 - A resolution authorizing and directing the City Manager to perform necessary activities to meet the requirement of the Public Utility Regulatory Policies Act of 1978 (PURPA) as amended by the Energy Independence and Security Act of 2007, to formally commence consideration of new Federal standards concerning integrated resources planning, rate design modification, Smart Grid and incentives for the recovery, use and prevention of industrial waste energy.




ORDINANCES

08-230 - 2R. An ordinance approving a revised Zoning Map Amendment by changing the zoning classification from R-1b (Single- Family Residential) and R-1b-SU (Single-Family Residential with a Special Use Permit for an airport) to R-3-PUD (Moderate-Density Residential-Planned Unit Development), CR-P-1 (Planned Limited Commercial and Residential), and C-P-2 (Planned General Commercial) and approve an amended Preliminary Development Plan for the property generally located northwest and west of Necessary Road and south and east of the future Little Blue Parkway. Case No. 08-125-01. Deferred to the February 2, 2009 Regular Agenda.



09-001 - 2R. An ordinance approving a Zoning Map Amendment by changing the zoning classification from R-1b (Single-Family Residential) and R-1b-SU (Single-Family Residential with a Special Use Permit for an airport) to C-P-1 (Planned Neighborhood Commercial) for the property located east of Little Blue Parkway and on the northeast corner of R. D. Mize Road and Necessary Road. Case No. 08-100-16.  Deferred to the February 2, 2009 Regular Agenda.



09-003 - 2R. An ordinance approving a Zoning Map Amendment by changing the zoning classification from C-P-2 (Planned General Commercial) to R-4-PUD (High-Density Residential Planned Unit Development) for the property located south of E. 23rd St. S., north of Medical Drive Parkway, east of S. R. D. Mize Road and west of Parkview Avenue. Case No. 08-125-03.



09-004 - 2R. An Ordinance repealing Article 4 of Chapter 4 of the Independence City Code and enacting a new Article 4 to adopt the 2006 Uniform Plumbing Code.



09-005 - 2R. An Ordinance appealing Article 5 of Chapter 4 of the Independence City Code and enacting in lieu thereof a new Article 5 to adopt the 2006 International Building Code.



09-006 - 2R. An Ordinance repealing Article 6 of Chapter 4 of the Independence City Code and enacting in lieu thereof a new Article 6, to adopt the 2006 International Mechanical Code.



09-007 - 2R. An Ordinance repealing Article 7 of Chapter 4 of the Independence City Code and enacting in lieu thereof a new Article 7 to adopt the 2008 National Electrical Code and establishing the effective date of the first reading as January 5, 2009.



09-008 - 2R. An Ordinance enacting a new Article 12 of Chapter 4 of the Independence City Code to establish an existing building code (Rehab Code) by adopting the 2006 edition of the International Existing Building Code.



09-009 - 2R. An Ordinance enacting a new Article 13 of Chapter 4 of the Independence City Code to establish a residential code by adopting the 2006 Edition of the International Residential Code.



09-010 - 2R. An Ordinance amending Article 5 of Chapter 20 of the Independence City Code to address grading construction and permit requirements.



09-011 - 2R. An ordinance repealing the 2003 International Fire Code and 2003 Life Safety Codes of the National Fire Codes as adopted and replacing it with the 2006 International Fire Code, 2006 Life Safety Codes of the National Fire Codes and associated changes and amendments as noted.



09-012 - 2R. An Ordinance Amending Chapter 9 of the City Code to permit the sale and use of fireworks.



09-013 - 2R. An ordinance amending City Code Article 9, Chapter 2 to prohibit minors from being in an intoxicated condition.



09-014 - 2R. An Ordinance approving the Blue Ridge Crossing East Tax Increment Financing Plan, approving a designation of blight within the redevelopment area, approving project areas within the redevelopment area, and approving Cinema East, LLC as the project developer.  Deferred to the February 17, 2009 Regular Agenda.



09-015 - 2R. An ordinance approving and designating the redevelopment project of the Blue Ridge Crossing East Tax Increment Financing Plan as a Redevelopment Project under the Real Property Tax Increment Allocation Redevelopment Act and adopting tax increment financing therein.  Deferred to the February 17, 2009 Regular Agenda.



09-016 - 2R. An ordinance approving Change Order No. 1 to contract 08-44 with Concorp, Inc. adding $103,000.00 for repair of Induced Draft Fans (“ID Fans”) at the Missouri City Power Plant Units No. 1 and No. 2 for the Power & Light Department. With the addition of this change order the total contract amount is $239,000.00.



09-017 - 2R. An ordinance authorizing City Manager to execute for and on behalf of the City a certain pipe line license to construct and maintain a water line on railroad right-of-way with the Union Pacific Railroad Company, on Ferguson Spring Road south of US 24 Hwy, Section 23, Township 50, Range 31, providing for payment to the railroad of One Thousand Five Hundred and No/100 dollars ($1,500.00), all in accordance with the attached pipe line license.



09-018 - 2R. An ordinance authorizing the City Manager to execute a Development Agreement Amendment No. 1 with Blue Ridge Retail-06, LLC, for storm water detention improvements related to the construction of the Blue Ridge Crossing Development.

An ordinance authorizing the City Manager to execute a price agreement (349-09) with Downey Construction, Inc., for concrete slabs, flatwork and footings for the Parks & Recreation Department for the period February 3, 2009, through January 31, 2010, with two, one-year renewal options.



09-021 - 1R. An ordinance authorizing the City Manager to sign and execute a contract with Wilson Plumbing for the 17th and Menown Sanitary Sewer project for an amount not to exceed $87,439.30 and authorizing the City Manager to approve minor change orders not to exceed $8,740.00 or for contract time adjustments.



09-022 - 1R. An Ordinance authorizing the City Manager to sign and execute a contract with Wil-Pav Inc. for the Holke Road Curve and Culvert project for an amount not to exceed $199,703.06 and authorizing the City Manager to approve minor change orders for an amount not to exceed $19,970.00 or for contract time adjustments.

An ordinance authorizing the City Manager to sign a contract with the firm of All Service Contracting Corporation to provide and install filter media and five filters at the Courtney Bend Water Plant for the full sum of $42,113.00 and authorizing the City Manager to approve time extension change orders and future minor change orders in a total amount not to exceed $4,211.00.



09-024 -1R. An ordinance authorizing the City Manager to execute a contract with WS Bunch for an amount not to exceed $41,750.00 for grit blast cleaning of the Blue Valley Unit 3 precipitator, for the Power & Light Department; and to approve administrative change orders for an amount not to exceed $4,175.00 and time extensions as deemed appropriate.



09-025 - 1R. An ordinance amending Chapter 2 of the City Code to include a Domestic Winery License as allowed by RSMo 311.190 and clarify the language when customers are allowed in a licensed premised.



09-503 - An emergency ordinance ratifying an Interlocal Agreement with Jackson County and the City of Kansas City, Missouri and authorizing the City Manager to accept funding from Jackson County for a 2008 Byrne Justice Assistance Grant award in the amount of $32,113.00 for law enforcement related equipment expenditures for the police department; appropriating the necessary funds in the operating budget; authorizing the city manager to sign future change orders, extensions, amendments or addendums for additional funding or time extensions for the same project; and authorizing certain future appropriations.
