PUBLIC HEARING

BP Quick Snack, application for a Retailer of Intoxicating Liquor in the Original Package License and a Sunday Sales License, located at 1001 W. US 24 Hwy. With residentially zoned property within 300 feet of the proposed premises, approval of this application will require a two-thirds Council approval. Full public hearing.




CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Approval is requested on the application of Novin Afshar and Parnian Habibi, for a Retailer of Intoxicating Liquor in the Original Package License and a Sunday Sales License for BP Quick Snack located at 1001 W. US 24 Highway. This application requires a two-thirds majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.



2.

Approval is recommended to issue Change Order 1 to PO 128597 to Electrical Corporation of America (ECA), adding $32,135.00 for the repair of the Cathodic Protection System at the Blue Valley Power Plant. This Change Order will bring the total amount of the Purchase Order to $47,085.00.



3.

Approval is recommended to issue a purchase order to Invensys Foxboro Systems, Inc., for an annual services agreement for the Distributive Control System at the Blue Valley Power Plant, in the amount of $60,320.00, for the Power & Light Department.



4.

Approval is recommended to issue a Purchase Order to JCI Industries, Inc., in the amount of $69,896.00, for the repairs of the Blue Valley Power Unit Circulating Water Pump and Motor for the Power & Light Department.



5.

Approval is recommended to enter into a price agreement (107-09) with Diamond International for OEM International truck parts and service for various City departments for the period of January 5, 2010, through December 31, 2010. Expenditures will not exceed budgeted amounts.



6.

Approval is recommended to issue a purchase order to Open Systems International, Inc., (OSI), in the amount of $59,320.00, to provide a Product Development System that is compatible with the existing Supervisory Control and Data Acquistion/Energy Management System (SCADA/EMS) software for the Power & Light Department.



7.

Approval is recommended to issue Change Order 1 to Phoenix Engineering & Surveying LLC, in the amount of $58,335.00, for additional work on the Waterfall to Little Blue Trace Connector Trail.  The new purchase order total is $80,935.00



8.

Approval is recommended to issue a purchase order, in the amount of $30,780.00, to Sega for engineering services to provide bid reviews, bid evaluations, and bid recommendations, along with a review of compliance submittals from the successful bidder on a project to institute a Maintenance Program for Water Treatment at the Blue Valley Power Plant.



9.

Approval is recommended to enter into a price agreement (344-09) for scaffolding with Patent Construction Systems, for the period of January 5, 2010, through December 31, 2010. The agreement includes two, one-year renewal options. Expenditures will not exceed budgeted amounts.

09-200 - 2R. An ordinance to vacate the right-of-way for a portion of a cul-de-sac on Lot 2 of Kidwell Acres located east of S. Jackson Drive and north of E. 37th Terrace. Case#09-700-04



09-201 - 2R. An ordinance authorizing execution of Change Order No. 1 to the contract for the Crane Street, Ferguson Spring Road and Lake City Valley Road with Beemer Construction Company, for an increase of $30,800.00.



09-202 - 2R. An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the construction, operation and maintenance of a public storm sewer designated as the Northern & Westport Storm Drainage Improvements, Project No. 70130701.



09-203 - 2R. An ordinance authorizing a contract with Wilson and Company to provide engineering services on the Norledge Place Street Improvements project for an amount not to exceed $47,000.00 and authorizing approval of minor change orders not to exceed $4,700.00 or for time adjustments.



09-204 - 2R. An ordinance authorizing and directing the City Manager to execute an Agreement with Northwest Communities Development Corporation to provide services utilizing Community Development Block Grant (CDBG) funds as specified in Ordinance No. 17294 for Program Year 35 (FY 2009-2010) for reimbursement, and authorizing the City Manager to sign certain limited change orders.



09-205 - 2R. An ordinance approving a Zoning Map Amendment by changing the zoning classification from R-12 (Residential 12) and R-30 (Residential-30) to R-6 (Residential 6); R-30 (Residential 30) to R-6 (Residential 6); R-12/HL (Residential 12 with Historic Landmark) to R-6/HL (Residential 6 with Historic Landmark), R-12 (Residential 12) to I-1 (Industrial) and R-12 (Residential 12) to R-6 (Residential 6) generally bounded on the north by the Missouri Pacific Railroad right-of-way; on the east by the intersection of said railway right-of-way and Lexington Avenue; on the south by E. Winner Road, and the west by S. Sterling Avenue. Case#09-100-10. This application requires a two-thirds majority vote for approval due to a valid protest petition having been submitted by property owners. (Motion passed at meeting to use alternate ordinance, which includes all original lots initially proposed for rezoning.)

An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the construction, operation and maintenance of a public storm sewer designated as the 35th & Northern Storm Drainage Improvements, Project No. 70130706.



09-207 - 2R. An ordinance finding, determining and declaring the necessity of acquiring fee-simple title, rights-of-way, general utility easements and temporary construction and grading easements for the construction, operation and maintenance of a public street designated at the Little Blue Parkway, 24 Highway Interchange, Project #70510802.

10-001 - 1R. An ordinance ratifying an Interlocal Agreement with Jackson County, Missouri, and accepting funding for a 2009 Byrne Justice Assistance Grant award in the amount of $101,293.00 for the Police Department; appropriating the necessary funds; and authorizing future change orders and appropriations for the same project.



10-002 - 1R. An ordinance authorizing a one-year lease with Culligan of Greater Kansas City to service and maintain a reverse osmosis water treatment system for the Power & Light Missouri City Plant at a cost not to exceed $23,700 per year, with City Option for renewal for four additional one-year terms.



10-003 - 1R. An ordinance authorizing a contract with GE Energy Services (“GE”) to replace the Controls System that operates the combustion turbine at Substation H for a price not to exceed $825,932.00; and administrative change orders not to exceed $82,593.00.



10-004 -1R. An ordinance authorizing a contract with GE Energy Services (“GE”) to replace the Exhaust Plenum and repair the Exhaust Diffuser on the H-6 combustion turbine at Substation H in an amount not to exceed $325,600; and administrative change orders not to exceed $32,560.00.



10-005 - 1R. An ordinance approving an agreement with Mid-Town Truman Road Corridor 353 Redevelopment Corporation for administration services and programmatic oversight.



10-006 - 1R. An ordinance authorizing a contract with Loch Sand and Construction for the Little Blue Parkway, R.D. Mize Road to Necessary Road, for an amount not to exceed $3,050,451.71; authorizing the City Manager to approve change orders not to exceed $305,000.00 or for time adjustments, approving change order number 1 to the contract for a $216,763.28 reduction, and making the necessary appropriations.



10-007 - 1R. An ordinance authorizing changes in authority for expenditure of funds, use of funds, priority of funds and directing the approach to project goals related to the Mid-Town/Truman Road Corridor (M/TRC) 353 Development Plan, as amended, and the related Tax Increment Financing (TIF) Redevelopment Plan approved by Ordinance 12904 and amending Ordinances 12904, 13056, 13249 and 14486, as necessary.

An ordinance authorizing a contract with GE Energy Services (“GE”) to conduct a Routine Turbine Inspection, Control System Upgrade and Full Compound Exciter Installation on Blue Valley Power Unit #3 for a price not to exceed $1,239,867.13; and to approve administrative change orders for an amount not to exceed $123,986.00 and time extensions.



10-009 - 1R. An ordinance authorizing the City Manager to execute a written agreement with Mid-America Regional Council for participation in the Kansas City Regional Housing Neighborhood Stabilization Program 2 (NSP2) Consortium which has been established for the purpose of redeveloping abandoned and foreclosed properties in eligible NSP2 target neighborhoods.

The Council is expected to convene in an Executive Session at 5:30 pm, Monday, January, 2010, prior to the Council Meeting, in Conference Room A on matters of Litigation and Labor Negotiations.



2.

The City Clerk has received notification from the City Manager that the agreement with The Benham Companies, LLC, for Events Center construction management and related services, has been extended through June 30, 2010.  This will allow an orderly completion of remaining tasks associated with the construction and opening of the Events Center.  The City Manager was given authority for time extensions by Ordinance No. 17012, approved by City Council on April 21, 2008.
