Reports and Recommendations of the City Manager
1.

Approval is recommended to enter into a price agreement (228-09) with Electric Power Systems to provide breaker and fused starter reconditioning and repair for the Power & Light Department. This is a one year agreement with two, one-year renewal options. Expenditures will not exceed budgeted amounts.

Approval is recommended to issue a change order to Purchase Order 129081 in the amount of $50,000.00 for hot mix asphaltic concrete for the Public Works Department.   The current purchase order issued to Vance Brothers, Inc., is $10,000.00.

Approval is recommended to issue a purchase order to the firm of Lutz, Daily & Brain, LLC (“LDB”), in the amount of $40,300.00, to provide an engineering inspection and assessment on the Blue Valley Power Plant coal handling conveyor structures.



4.

Approval is recommended to enter into a price agreement (127-09) with Courtney Ridge Landfill, LLC, for landfill services for various City departments, for the period November 3, 2009, through October 31, 2010.  The agreement may be renewed at the sole option of the City for two, one-year terms.  Expenditures will not exceed budgeted amounts.

Approval is requested to authorize the Director of Finance & Administration to sign a five (5) year extension to the Credit Card Services Agreement with Elavon, Inc.

Approval is recommended to enter into a price agreement (133-09) with Santa Fe Glass and Kyrger Glass for auto, heavy vehicular and building glass replacement/repair services for the period November 3, 2009, through October 31, 2010, with four, one-year renewal options.  Expenditures will not exceed budgeted amounts.

Approval is recommended to enter into a price agreement with Machinery Diagnostics & Consulting, LLC, to provide preventive maintenance technical services for the Power & Light Department. This is a one-year agreement with four, one-year renewal options. Expenditures will not exceed budgeted amounts.

09-760 - A resolution recognizing Regina Moore, Administrative Specialist III in the Community Development Department, as the Employee of the Month for November, 2009.



09-761 - A resolution declaring the estimated population of the City of Independence, Missouri, for July 1, 2009, made in conformance with Section 2.01.005 of the City Code, to be 120,388.



09-762 - A resolution reappointing Dr. Howard H. Braby to the Independence Advisory Board of Health to a term expiring 11/6/2012.



09-763 - A resolution affirming Councilmember Paris' reappointment of Paul Newberry to the Street Improvement Oversight Committee to a term expiring 10/1/2012.



09-764 - A resolution affirming Councilmember Paris' reappointment of Ron Yale to the Public Safety Sales Tax Oversight Committee to a term expiring 11/15/2012.



09-765 - A resolution appointing Virginia DeBoard to the City Beautification Commission to a term expiring 6/15/2012.



09-766 - A resolution in support of the Mount Washington School Project, a proposed development for senior citizens. (Amended at the meeting to support the application for funding.)

09-163 - 2R. An ordinance vacating portions of street rights-of-way located generally on the east side of Memorial Drive between White Oak Avenue and Noland Road; Memorial Drive between Truman Road and White Oak Avenue; and the semi-circular connector road between Truman Road and White Oak Avenue, immediately west of Memorial Drive. 09-164 - 2R. An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the construction, operation and maintenance of a public storm sewer designated as the 19th & Cedar (South Maywood) Storm Drainage Improvements, Project No. 70130502.



09-165 - 2R. An ordinance ratifying an Interlocal Agreement with Kansas City, Missouri and accepting funding for a 2009 Recovery Act: Justice Assistance Grant (JAG) award in the amount of $416,745.99 for the Police Department; appropriating the necessary funds; authorizing the City Manager to sign future change orders for the same project, and authorizing certain future appropriations.



09-166 - 2R. An ordinance authorizing the City Manager to execute an agreement with the Missouri Division of Family Services for participation in the Low Income Home Energy Assistance Program during the fiscal year 2009-2010 and four (4) additional one-year renewal periods.



09-167 - 2R. An ordinance approving the petition for and establishing the Noland Fashion Square Community Improvement District (CID) for the purpose of collecting sales and use tax, to provide for site improvements, to provide for the administration of the District, to provide for the maintenance of public improvements, authorizing other actions related to the District, and declaring blight.

An ordinance approving a Zoning Map Amendment by changing the zoning classification from R-12 (Residential 12) and I-1 (Industrial) to R-6 (Residential 6) for the area generally located north of 23rd Street, east of Pleasant Avenue, west of Main Street and south of Pacific Avenue. An ordinance authorizing acceptance of funding from the Missouri Department of Public Safety in the amount of $26,397.70 from the 2009 POST Commission Training Fund for law enforcement training; and authorizing the City Manager to accept additional fund distributions for the same fiscal year. 



09-176 - 1R. An ordinance amending Article 35 Chapter 1 of the City Code by changing the structure of the Independence Advisory Board of Health.



09-177 - 1R. An ordinance authorizing a contract with Kleinfelder Central for the Van Hook Park Engineering Services for an amount not to exceed $140,500.00 and authorizing the City Manager to approve change orders not to exceed $14,500.00 and/or time extensions.



09-178 - 1R. An ordinance authorizing the City Manager to sign a contract with Pyramid Excavating for the Jackson Drive, Holke Road to 78 Highway, project for an amount not to exceed $1,016,096.05, authorizing the City Manager to approve minor change orders for an amount not to exceed $101,000.00 and/or for time extensions, and making the necessary appropriations.



09-179 - 1R. An ordinance authorizing the City of Independence to enter into a Cooperative Agreement with the City of Kansas City, Mo., to administer and conduct certain services in connection with a Low-Income Residential Weatherization Program to benefit qualified residential customers of Independence Power & Light.

09-553 - An ordinance increasing appropriations in the amount of $21,981,947.38 in the Operating and Capital Budgets for various departments and capital projects, transferring appropriations in the amount of $4,820,000.00 in the Capital Budget in the Power & Light Department, and making other budget adjustments as necessary for the City of Independence, Missouri, for the Fiscal Year July 1, 2009, through June 30, 2010. Appropriation ordinances may receive two readings and be voted on at the same meeting.



09-554 - An emergency ordinance authorizing a Corporate Sponsorship Agreement for the Independence Events Center with Centerpoint Medical Center. (Read out of order and clarified naming rights apply to Community Ice.)
