Reports and Recommendations of the City Manager
1.

Approval is requested on the application of Neelam, Inc. to transfer the existing Retailer of Intoxicating Liquor in the Original Package License and Sunday Sales License for the 7-Eleven Store #13294C, located at 11001 E 23rd Street to them as the new operator of this convenience store.



2.

Approval is recommended to issue a change order to Purchase Order 121944, in the amount of $5,950.00, for the Jackson Drive Street Project and to approve the first change order to this purchase order in the amount of $14,450.  The new purchase order total will be $182,275.00.



3.

Approval is recommended to enter into a price agreement (306-08) with Metro Ford to provide OEM Ford Truck Service for various City departments for the period of December 16, 2008, through November 30, 2009. with two optional one-year renewal periods. Expenditures will not exceed budgeted amounts.




Resolutions:

08-792 - A resolution recognizing Lynda Kidwell, Accreditation Administrator in the Police Department, as the Employee of the Month for January, 2009.



09-700 - A resolution amending Resolution No. 5474 to correct the appointment of James M. Farrow as an alternate member of the Board of Adjustment.




ORDINANCES

08-239 - 2R. An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the construction, operation and maintenance of a public storm sewer designated as the Denton and Arlington Storm Sewer Improvements, Project No. 70130604.



08-240 - 2R. An ordinance authorizing the City Manager to sign a Pipe Line license Agreement with the Union Pacific Railroad to allow the City to construct and maintain a water line across the railroad right-of-way, for an expenditure of $1,500.00.



08-241 - 2R. An Ordinance authorizing the City Manager to sign and execute an Amendment No. 1 to the Community Development Block Grant Commercial Façade Improvement Program contract agreement with Portrait Gallery w/ Photography by Karen for rehabilitation of the building located at 124 S. Main Street, reflecting an amended scope of work and an amended grant award not to exceed $35,000.00.

09-014 - 1R. An Ordinance approving the Blue Ridge Crossing East Tax Increment Financing Plan, approving a designation of blight within the redevelopment area, approving project areas within the redevelopment area, and approving Cinema East, LLC as the project developer.



09-015 - 1R. An ordinance approving and designating the redevelopment project of the Blue Ridge Crossing East Tax Increment Financing Plan as a Redevelopment Project under the Real Property Tax Increment Allocation Redevelopment Act and adopting tax increment financing therein.



09-016 - 1R. An ordinance approving Change Order No. 1 to contract 08-44 with Concorp, Inc. adding $103,000.00 for repair of Induced Draft Fans (“ID Fans”) at the Missouri City Power Plant Units No. 1 and No. 2 for the Power & Light Department. With the addition of this change order the total contract amount is $239,000.00.

An ordinance authorizing City Manager to execute for and on behalf of the City a certain pipe line license to construct and maintain a water line on railroad right-of-way with the Union Pacific Railroad Company, on Ferguson Spring Road south of US 24 Hwy, Section 23, Township 50, Range 31, providing for payment to the railroad of One Thousand Five Hundred and No/100 dollars ($1,500.00), all in accordance with the attached pipe line license.



09-018 - 1R. An ordinance authorizing the City Manager to execute a Development Agreement Amendment No. 1 with Blue Ridge Retail-06, LLC, for storm water detention improvements related to the construction of the Blue Ridge Crossing Development.



09-500 - An emergency ordinance authorizing the City Manager to accept a one-year grant award from the Missouri Department of Public Safety, in the amount of $49,338.72, making the necessary appropriations, and authorizing future change orders, extensions and amendments for additional funding for the Independence STOP Violence Against Women program.



09-501 - An emergency ordinance approving the Final Plat for Eastland Business Center North - 3rd Plat, P.U.D., a commercial subdivision located south of Valley View Parkway and northeast of Ehrhart Drive. Case No. 08-320-27.



09-502 - An emergency ordinance authorizing the City Manager to negotiate and execute a Cooperative Agreement with BNSF Railway for conveyance of certain easements and to permit BNSF Railway to relocate, lower or encase certain City water and sewer pipelines, making the necessary appropriations.
