Reports and Recommendations of the City Manager
1.

Approval is recommended to issue Change Order 1, adding $90,000.00 to Purchase Order 127147, to Analytical Solutions & Providers, for the purchase of an Agilent 7890 Network GC System for the Police Department. This change order will bring the total amount of the purchase order to $165,000.00.

Approval is recommended to enter into a price agreement (235-08) with Metro Ford to provide Ford parts and service for various City departments for the period of November 18, 2008, through October 31, 2009.  Expenditures will not exceed budgeted amounts.



3.

Approval is recommended to enter into a price agreement (118-08) with Murphy Tractor & Equipment Co. and Heritage Tractor, Inc., for various departments for OEM John Deere Parts & Service for the period of November 18, 2008, through October 31, 2009, with two, one-year renewal options. Expenditures will not exceed budgeted amounts.

Approval is requested on the application of Pop N Dars Stop N Go, LLC, for a Retailer of Malt Liquor & Light Wine in the Original Package License for Pop N Dars Stop N Go located at 603 E. 23rd Street, transferring the existing liquor licenses into their name.

5.

Approval is recommended to issue Change Order 1 to Purchase Order 124680 to Archer Engineers (d.b.a. HDR/Archer) in the amount $8,100.00 for additional engineering services related to the Extraneous Flow Holding Basin (RFHB) within the Redwood Sanitary Sewer Capital Improvement Project area for the Water Pollution Control Department. This change order will bring the total amount of the purchase order to $53,100.00.



6.

Approval is requested to authorize settlement in City of Independence, Missouri v. William Kidwell, et al., on Exceptions of Smiley, et al., Case No. 0716-CV14065-03.



7.

Approval is requested on the application of Noland Restaurant, LLP, for a Retailer of Intoxicating Liquor by Drink (Restaurant/Bar) License and Sunday Sales License of Noland Restaurant for Side Pockets Restaurant & Bar located at 4470 S. Noland Road, transferring the existing liquor license into their name.

Approval is recommended to issue a purchase order to Northstar Technologies, LLC, for stormwater management and engineering services for a one-year period in an amount not to exceed $85,000.00, with an option to renew for a second year at the same amount, for the Water Pollution Control Department, Storm Water Division.

08-776 - A resolution authorizing the City Manager to execute a “Continuing Disclosure Agreement” with Omaha Public Power District (OPPD) and authorizing the City Counselor to execute and deliver a “Certificate of Participant” to OPPD regarding the Power & Light Department’s participation in OPPD’s Nebraska City generating unit No. 2.



08-777 - A resolution reappointing Thomas Woods to the License Surcharge Annual Review Committee to a term expiring September 17, 2011.




ORDINANCES

08-206 - 2R. An ordinance adopting the attached schedules of electric rates to be effective January 2009, July 2009, July 2010, July 2011 and July 2012.



08-207 - 2R. An ordinance directing the City Manager to execute agreements utilizing funds from the BP Amoco Revolving Loan Fund. This will direct $12,735 to create a Revolving Loan Fund at the Truman Heartland Community Foundation and loan $54,500 to the Northwest Communities Development Corporation for the Norledge Place project.



08-208 - 2R. An ordinance repealing Ordinance # 17154 to allow the correction of an error regarding an application to establish a Special Character District Overlay and approve a Master Sign Plan for the Independence Center. Case#08-100-12



08-209 - 2R. An ordinance approving a Final Development Plan of Recovery Management Corporation (Cargo Largo), Case No. 08-825-02, a Planned Unit Development located northwest of East 35th Street and Noland Road.



08-210 - 2R. An ordinance authorizing the City Manager to execute a contract with Genesis Environmental Solutions, Inc., in the amount of $74,582.90 to perform Tank Integrity Inspections on eleven above-ground fuel oil storage tanks for the Power & Light Department.



08-211 - 2R. An ordinance authorizing the City Manager and the Power & Light Director to: (1) Accept a grant from the Missouri State Emergency Management Agency’s Hazardous Mitigation Grant Program for $1,823,250.00 to convert approximately 1,870 overhead electric services from overhead to underground; (2) provide $607,750.00 matching funds from the Power & Light budget, and; (3) make necessary appropriations.



08-212 - 2R. An ordinance authorizing and directing the City Manager to execute an Agreement with Northwest Communities Development Corporation to provide services utilizing Community Development Block Grant (CDBG) funds as specified in Ordinance No. 17009 for Program Year 34 (FY 2008-2009) for reimbursement to them of monies available through the U.S. Department of Housing and Urban Development for services to low/moderate income persons, and authorizing the City Manager to sign certain limited change orders.



08-213 - 2R. An ordinance authorizing a transfer of funds to the Northwest Community Development Corporation (NWCDC) from the funds available in the Rock Creek Community Center Fund held at the Truman Heartland Community Foundation and appropriating $27,042 in the General Fund Non-Departmental Account.



08-214 - 2R. An ordinance authorizing the execution of a certain Service Agreement with RCC Consultants, Inc., to research and negotiate a settlement with the purchasing entity of the Power & Light Department microwave communications license.



08-215 - 2R. An ordinance authorizing the City Manager to sign and execute a contract with JCI Industries, Inc., for Circulating Water Pump and Motor repairs at the Power & Light Blue Valley Power Plant for an amount not to exceed $44,618.00, and to approve administrative change orders for an amount not to exceed $4,461 and time extensions as deemed appropriate.



08-216 - 2R. An ordinance authorizing the City Manager to sign and execute a contract with JCI Industries, Inc., for Circulating Water Pump and Motor repairs at the Missouri City Power Plant for an amount not to exceed $35,274.00 and to approve administrative change orders for an amount not to exceed $3,527.00 and time extensions as deemed appropriate.



08-217 - 2R. An ordinance authorizing the City Manager to enter into a license agreement with Missouri Logos to allow posting of Trailblazer signs, a component of the Missouri Department of Transportation’s Logos signing program, in the City rights-of-way according to the specifications of the license agreement.



08-218 - 2R. An ordinance authorizing the vacation of a portion of Pleasant Grove School Road located in the Southwest Quarter of the Northwest Quarter of Section 29, Township 49 North, Range 31 West, in Independence, Jackson County, Missouri.



08-219 - 2R. An ordinance authorizing the City Manager to execute a contract for license of the public area of the Independence Square and vicinity in connection with the Santa-Cali-Gon Fair with the Independence Chamber of Commerce, from September 3 through September 7, 2009.



08-220 - 2R. An ordinance authorizing the City Manager to execute a contract with Lee Mathews Equipment, Inc., in the amount of $85,558.00 to furnish and install a new River Pump to supply water from the Missouri River to the fly ash removal system at the Power & Light Missouri City facility.

An ordinance authorizing the City Manager to sign a contract with Legacy Inmate Communications to provide Inmate Security Phone System and Services for the City of Independence, Police Department, effective November 1, 2008, through November 1, 2009, with four, one-year renewal options, with the City to receive 60% of the revenues as Legacy Inmate Communications supplies, upgrades and maintains the system and equipment.
