A public hearing for the purpose of discussing the proposed budget for the July 1, 2017 – June 30, 2018, fiscal year. Full Public Hearing.

CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Council action is requested on the application received from Delaware Event Space, LLC for an Intoxicating Liquor by Drink License and Sunday Sales License for Delaware Event Space located at 125 S. Main Street. This application requires a two-third majority vote for approval due to a college being located within three hundred (300) feet of the establishment. 



2.

Council action is requested on the application received from Mayan Commercial LLC to transfer the existing Intoxicating Liquor in the Original Package License, Sunday Sales and Liquor Tasting License to Fast Mart at 11100 E US 40 Highway as the new operator of this convenience store. 



3.

Council action is requested to issue Change Order No. 1 to Purchase Order 145572, in the amount of $217,751.00, to Siemens Energy for turbine repairs and generator bearings for the Power & Light Department. If approved, the new purchase order total will be $342,044.00.




Resolutions:

17-738 - A resolution amending the Pay Plan for Non-Represented City Employees as enumerated herein on and after the 15th day of May 2017; reclassify (1) class title.



17-739 - A resolution appointing Ronald Hickey, Scott Higgs, Jerry Page, and Heather Wiley as members to the Comprehensive Plan Steering Committee.



17-740 - A resolution adopting the 2017 Federal Legislative Policy.



17-741 - A resolution allocating $16,169.00 from the General Fund to the Missouri Municipal League for the reimbursement of legal expenses related to a settlement agreement with TracFone Wireless, Inc.




ORDINANCES

17-045 - 2R. An ordinance amending Chapter 20 of the Independence City Code, by amending Article 19, Use of Public Rights-of-Way.



17-046 - 2R. An ordinance amending the Zoning District Map as to a tract of ground located at 19411 E. Valley View Pkwy. From District O-1 (Office-Residential) to District C-2 (General Commercial) in Independence, Jackson County, Missouri.



17-047 - 2R. An ordinance authorizing execution of a contract with Danford Engineering, LLC., in an amount not to exceed $160,000.00, for engineering services for the substation “E” to substation “F” 69 kV Transmission Line Rebuild project; and authorizing future minor change orders for an amount not to exceed $16,000.00 and/or time extensions.



17-048 - 2R. An ordinance amending the Zoning District Map as to a tract of ground located south of East 18th Street to a point south of East 20th Street from District R-12 (Two-Family Residential) to District I-1 (Industrial) in Independence, Jackson County, Missouri.



17-049 - 2R. An ordinance imposing a Transportation Sales Tax at the rate of one-half of one percent of the receipts from the sale at retail of all tangible personal property or taxable services at retail within the City of Independence, Missouri, to be effective January 1, 2020, which shall remain in effect at said rate thereafter until repealed, subject to the approval of such ordinance by the voters of the City, all as provided by the Transportation Sales Tax act of the State of Missouri; and further calling for the proposition adopting said Transportation Sales Tax to be placed on the ballot at the regularly scheduled election to be held August 8, 2017, and proposing the form of the ballots to be employed at said election and directing the City Clerk to do all things called for by law in connection with the holding of said election. 



17-050 -2R. An ordinance imposing a use tax  at the rate of two and one quarter percent (2.25%) for the privilege of storing, using, or consuming within the city any article of tangible personal property pursuant to the authority granted by the and subject to the provision of Sections 144.600 through 144.761 RSMo; providing for the use tax to be repealed, reduced or raised in the same amount as any city sales tax is repealed, reduced, or raised; and providing for submission of the proposal to the qualified voters of the city for their approval at the special election called and to be held in the city on August 8, 2017, and proposing the form of the ballots to be employed at said election and directing the City Clerk to do all things called for by law in connection with the holding of said election.

An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the 16th and Scott Avenue Stormwater and Sanitary Sewer Project (Project No. 70131503 and Project No. 70300801); authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



17-053 - 1R. An ordinance amending Article 3 of Chapter 5 of the City Code by amending Section 5.03.001 and enacting new sections to add requirements for hotels, motels, and moving an existing hotel-motel requirement from Chapter 12 to Chapter 5.



17-054 - 1R. An Ordinance Amending Article 11, "Ice Handler Permit Required" of Chapter 11 of the City Code; Amending Article 3, "Keeping of Pit Bulls Prohibited" of Chapter 3 of the City Code; Deleting and moving said fees to the Schedule of Fees, all amendments outlined in this Ordinance to become effective July 1, 2017.



17-056 - 1R. An ordinance amending Article 5, “Excavation, Grading and Site Preparation Specifications” of Chapter 20 of the City Code; amending Article 14, “Permits and Fees” of Chapter 20 of the City Code; and deleting and moving said fees to the Schedule of Fees, all amendments outlined in this ordinance to become effective July 1, 2017.



17-057 -1R. An ordinance amending Section 2.10.021 of the Independence City Code to allow alcohol to be consumed on certain public property for certain events.



17-058 - 1R. An ordinance authorizing the City Manager to execute an agreement between City of Independence Power and Light Department and AT&T for joint use pole attachments. This will have no effect on any tax revenues or general revenues.



17-059 - 1R. An ordinance finding, determining and declaring the necessity of acquiring certain fee simple title for the property described as Rockwood Golf Course; directing the city manager to negotiate the terms of acquisition; and allocating city council goals funds for administrative expenses related to negotiations.  [Requested by Councilmember Van Camp]
