Reports and Recommendations of the City Manager
1.

Council action is requested on the application received from Delaware Event Space, LLC for an Intoxicating Liquor by Drink License and Sunday Sales License for Delaware Event Space located at 125 S. Main Street. This application requires a two-third majority vote for approval due to a college being located within three hundred (300) feet of the establishment. Council action is requested on the application received from Dew-Raw, Inc. to transfer the existing Restaurant Bar Intoxicating Liquor by Drink License and Sunday Sales License for Minsky’s Pizza  located at 2551 S. M 291 Highway as the new owner of this establishment.



3.

Council action is requested to issue a purchase order, in the amount of $171,860.00, to Open Systems International, Inc. for Supervisory Control and Data Acquisition/Energy Management System (SCADA/EMS) control system work for the Power & Light Department.



4.

Approval is recommended to amend the Schedule of Fees for the City of Independence effective July 1, 2017.




Resolutions:

17-743 - A resolution approving a preliminary plat of Blue Ridge Mountain, a replat of Blue Ridge Mountain View, located south of East 18th street to a point south of East 20th Street, in Independence, Jackson County, Missouri.



17-744 - A resolution establishing the Bargaining Unit Pay Plan for city employees as enumerated herein retroactive to the 20th day of January 2017.



17-745 - A resolution amending the Pay Plan for Non-Represented City Employees as enumerated herein on and after the 5th day of June 2017; add one (1) and reclassify one (1) class title.



17-746 - A resolution declaring the policy of the City Council respecting expenditures for public art to adorn public buildings and property in the City of Independence, Missouri.




ORDINANCES

17-052 - 2R. An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the 16th and Scott Avenue Stormwater and Sanitary Sewer Project (Project No. 70131503 and Project No. 70300801); authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



17-053 - 2R. An ordinance amending Article 3 of Chapter 5 of the City Code by amending Section 5.03.001 and enacting new sections to add requirements for hotels, motels, and moving an existing hotel-motel requirement from Chapter 12 to Chapter 5.



17-054 - 2R. An ordinance finding, determining and declaring the necessity of acquiring general utility easements and temporary construction and grading easements for the Sidewalks to Parks Project (No. 70110807); authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



17-055 - 2R. An Ordinance Amending Article 11, "Ice Handler Permit Required" of Chapter 11 of the City Code; Amending Article 3, "Keeping of Pit Bulls Prohibited" of Chapter 3 of the City Code; Deleting and moving said fees to the Schedule of Fees, all amendments outlined in this Ordinance to become effective July 1, 2017.



17-056 - 2R. An ordinance amending Article 5, “Excavation, Grading and Site Preparation Specifications” of Chapter 20 of the City Code; amending Article 14, “Permits and Fees” of Chapter 20 of the City Code; and deleting and moving said fees to the Schedule of Fees, all amendments outlined in this ordinance to become effective July 1, 2017.



17-057 -2R. An ordinance amending Section 2.10.021 of the Independence City Code to allow alcohol to be consumed on certain public property for certain events.



17-058 - 2R. An ordinance authorizing the City Manager to execute an agreement between City of Independence Power and Light Department and AT&T for joint use pole attachments. This will have no effect on any tax revenues or general revenues.

17-059 - 1R. An ordinance finding, determining and declaring the necessity of acquiring certain fee simple title for the property described as Rockwood Golf Course; directing the city manager to negotiate the terms of acquisition; and allocating city council goals funds for administrative expenses related to negotiations.  [Requested by Councilmember Van Camp; Staff recommends postponing until September 18, 2017.]



17-060 - 1R. An ordinance amending Chapter 4 of the Independence City Code requiring that when a nonresidential dangerous building is repaired, the exterior must be improved as required by the Unified Development Ordinance.



17-061 - 1R. An ordinance authorizing a contract with the Kansas City Area Transportation Authority for the purpose of providing Inter-City bus services in and to the City of Independence, Inter-City and Intra-City paratransit services and transit management services for the period of July 1, 2017 through June 30, 2018.



17-062 - 1R. An ordinance amending the Unified Development Ordinance, Chapter 14, of the Independence City Code which will require that when a nonresidential dangerous building is repaired, all street facing elevations must be rebuilt with compatible materials and design.



17-063 - 1R. An ordinance authorizing the City Manager to execute a Conduit Space License and Right of Way Access Agreement With Unite Private Networks providing the use of conduit space for the City’s fiber optic cable to connect the water plant.



17-064 - 1R. An ordinance authorizing the borrowing of not to exceed $11,000,000 from the Missouri Development Finance Board in connection with the refinancing of certain costs related to a tax increment financing plan previously approved by the city for an area generally known as Eastland; approving the form of and authorizing the execution of a supplemental financing agreement relating to such project with the Missouri Development Finance Board; providing for the administration of a special allocation fund previously created by the city; and prescribing other matters relating thereto.



17-065 - 1R. An ordinance authorizing the borrowing of not to exceed $2,400,000 from the Missouri Development Finance board in connection with the refinancing of certain costs related to a tax increment financing plan previously approved by the city for an area generally known as Hartman Heritage; approving the form of and authorizing the execution of a supplemental financing agreement relating to such project with the Missouri Development Finance Board; providing for the administration of a special allocation fund previously created by the city; and prescribing other matters relating thereto.



17-066 - 1R. An ordinance adopting the Annual Operating and Capital Budgets of the City of Independence, Missouri, for the Fiscal Year July 1, 2017 - June 30, 2018, estimating the revenues for said fiscal year; appropriating sums for the purposes stated in said budget, establishing operating transfers, designating fund balance allocations, establishing the authorized table of organization, and designating those who may make a requisition for encumbrances against appropriations.



17-067 - 1R. An ordinance estimating revenue and increasing appropriations in the amount of $268,963.11 in the General Fund; estimating revenue and increasing appropriations in the amount of $15,726.18 in the Parks Sales Tax Fund; estimating revenue and increasing appropriations in the amount of $492,332.42 in the Grants Fund; estimating revenue and increasing appropriations in the amount of $75,375.00 in the Police Public Safety Sales Tax Fund; and, increasing appropriations in the amount of $210,626.00 in the Water Fund.



17-068 - 1R. An ordinance amending Ordinance No. 18749 by amending Chapter 4, Article 15, “Rental Ready Program” inspection requirements for rental properties. [Requested by Councilmember Van Camp]



17-504 - 1R. An ordinance authorizing an agreement with the Fraternal Order of Police (FOP), Lodge No. 1, for the term of July 1, 2017, through June 30, 2020, and declaring an emergency.



INFORMATION ONLY:
1.

The City Council is expected to convene in an Executive Session at 5:15 pm, Monday, June 5, 2017, in Conference Room A, on matters of Labor Negotiations, as permitted by Sec. 610.021(9).



2.

The City Clerk has received notification that the City Manager has accepted a donation of two Ceremonial Parade Rifles from Chad Clayton, President of Security Management Solutions. These rifles will be used by the Independence Police Department Honor Guard.



3.

The City Clerk has received notification that the City Manager has accepted a grant from the Missouri Highways and Transportation Commission in the amount of $800, for the Police Department. These funds will be used to reimburse police officers for overtime worked while enforcing traffic laws pertaining to speed,aggressive driving, DWI, seat belt and child safety restraint.
