Reports and Recommendations of the City Manager
1.

Approval is recommended to award the City’s excess liability insurance program through Lockton Companies, with ten million dollars of coverage provided by Allied World Insurance Company, effective January 1, 2017, with an annual premium of $175,059.



2.

Approval is recommended to renew the City’s general liability, employment practice liability, medical malpractice liability, employee benefits liability, public official liability, law enforcement liability, garage keepers liability, automobile liability insurance and cyber & information breach liability coverage with Missouri Public Entity Risk Management Fund effective January 1, 2017, with an estimated annual premium of $593,056.



3.

Council action is requested on the application received from QuikTrip Corporation to transfer the existing an Intoxicating Liquor in the Original Package License and Sunday Sales License for the QuikTrip #205R convenience store with gas sales located at 11101 E. US 40 Highway.  This application requires a two-third majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.




Resolutions:

16-788 - A resolution amending the Pay Plan for Non-Represented City employees as enumerated herein on and after the 21st day of November 2016; add one (1) class title. Item has been withdrawn by City Manager.



16-801 - A resolution appointing Mark Slodovnik to the Citizens with Disabilities Advisory Board of the City of Independence, Missouri.




ORDINANCES

16-134 -2R. An ordinance amending Ordinance No. 18672 by correcting the legal description for the area of utility easement to be vacated. [Motion made to amend legal description by inserting the word "North" on the 8th line from the top of the legal description between the words "former" and "Right".]



16-135 - 2R. An ordinance amending Chapter 9 of the “Code of the City of Independence, Missouri”, by amending the local amendment to the International Fire Code provision on the number of fireworks stand licenses available for issuance and to eliminate the grandfathering process of issuing licenses to not-for-profit organizations.



16-136 - 2R. An ordinance authorizing a contract with Performance Contracting, Inc. to paint the interior and exterior of Settling Basin No. 3 and associated structures at the Courtney Bend Water Plant for the full sum of $438,464.00; authorizing future minor change orders in a total amount not to exceed $43,846.40; and/or time extensions.



16-137 - 2R. An ordinance amending the zoning district map as to a tract of ground located at 2133 S. Norwood Avenue from District C-2 (General Commercial) to District R-6 (Single-Family Residential) in Independence, Jackson County, Missouri.



16-138 - 2R. An ordinance authorizing final disposition of certain city records that have met all requirements to be eligible for such disposition.



16-139 - 2R. An ordinance authorizing a contract with Mega Industries for the Nativity School Sidewalks to Schools Project (No. 70110808) for an amount not to exceed $283,803.70 authorizing future minor change orders for an amount not to exceed $28,380.00 and/or time extensions, and increasing project appropriations.



16-140 - 2R. An ordinance authorizing the City Manager to sign and execute a contract with Hoefer Wysocki Architects for the Police/Fire Communications Center Project (No. 70571601) for an amount not to exceed $442,500.00; authorizing the City Manager to approve minor change orders for an amount not to exceed $44,000.00 and/or time extensions; and making an appropriation.



16-141 - 2R. An ordinance approving a development agreement between the City of Independence, Missouri and New Town at Harmony, LLC, for the New Town at Harmony Development.

16-142 - 1R. An ordinance amending the Stay Well Open Access Health Care Plans 1 and 2 document to add the ability to fill a 90 day supply of maintenance prescriptions at certain contracted retail pharmacies effective February 1, 2017.



16-143 - 1R. An ordinance repealing Article 7 of Chapter 17 of the City Code and enacting in lieu thereof a new Article 7 to adopt the most recent model Floodplain Management Ordinance, repealing the conflicting provisions of Ordinance Nos. 12409,14373 and 16466 and all other ordinances and parts of ordinances in conflict herewith. [Motion made to read Bill No. 16-143 as an emergency.]



16-144 - 1R. An ordinance authorizing a contract with Pyramid Excavation and Construction for the M-78 and Truman Road Intersection Improvements Project (No. 70111307) for an amount not to exceed $1,761,682.35, authorizing future minor change orders for an amount not to exceed $176,100.00 and/or time extensions, and increasing project appropriations.



16-520 - 1R. An ordinance approving a final plat of New Town at Harmony, plat one, located north of E. Truman Road, between S. Fisher Road and the Little Blue River, in Independence, Jackson County, Missouri; and declaring an emergency.

1.

Municipal Court Monthly Case Summary Report for November, 2016.



2.

The Law Department is providing the following notification to the City Council of the claims paid and received during November, 2016.



3.

The City Clerk has received notification that the City Manager has accepted a grant from the Organized Crime Drug Enforcement Task Forces (OCDETF) in the amount of $10,000.00, for the Police Department. These funds will be used to for the purpose of overtime funding for detectives to continue assisting on an investigation led by OCDETF.



4.

The City Clerk has received notification that the City Manager has accepted a grant from the United States Tennis Association - Missouri Valley District in the amount of $950.00, for the Parks, Recreation, Tourism Department. These funds will be used to for the purchase of adaptive tennis equipment for the new inclusive tennis program.



5.

The City Clerk has received notification that the City Manager has accepted a donation from the First Baptist Church of Independence in the amount of $50.00, for the Police Department. These funds have been deposited in Police Equipment Enhancement & Improvement Fund at the Truman Heartland Foundation.



6.

The City Council is expected to convene in an Executive Session at 5:30 pm, Monday, December 19, 2016, in Conference Room A, on matters of sealed proposals and documents, as permitted by Sec. 610.021(12), RsMO and matters of real estate as permitted by Sec. 610.021(2), RsMO.
