PUBLIC HEARING

An application by McClain Restaurant Group, Inc.to expand the license premises of their Restaurant Bar Intoxicating Liquor by the Drink License and Sunday Sales License for New Diamond Bowl located at 218 N Osage St. to add the interior space of 222 N. Osage St. Full Public Hearing. [Consent Agenda Item No. 1]  This application requires a two-third majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.

Reports and Recommendations of the City Manager
1.

Council action is requested on the application by McClain Group, Inc. to expand the licensed premises for Restaurant/Bar Intoxicating Liquor by the Drink License and Sunday Sales License for New Diamond Bowl located at 218 N. Osage Street. This application requires a two-third majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.

Council action is requested on the application received from Midas Hospitality, LLC to transfer the existing Hotel Malt Liquor and Light Wine by Drink License and Sunday Sales License for Staybridge Suites located at 19400 E. 39th Place S. into their name as the new owner and property manager of this hotel.



3.

Council action is requested to enter into a price agreement (323-16) with Jackson County Electrical Services, to provided electrical services for City buildings, for the period November 1, 2016, through October 31, 2017, with four, one-year renewal options.  Expenditures will not exceed budgeted amounts. [Postponed from October 3, 2016 Council Meeting.]




Resolutions:

16-782 - A resolution amending the Pay Plan for Non-Represented City Employees as enumerated herein on and after the 17th day of October 2016; change pay grade of one position and adjust the B44 through B48 maximum pay grade range for classified and unclassified positions by 10% to create a more competitive salary range for the hiring of department directors and above.




ORDINANCES

16-102 - 2R. An ordinance authorizing a contract with Stantec Consulting Services Inc. for a pavement management system analysis, for an amount not to exceed $215,600.00; authorizing future minor change orders for an amount not to exceed $21,560.00 and/or time extensions; and making the necessary appropriations.



16-103 - 2R. An ordinance authorizing a contract with the Department of Justice for the 2016 Improving Criminal Justice Responses Program in the amount of $450,000.00; appropriating the necessary funds in the Police Department and Law Department Operating Budgets; making the necessary appropriations; authorizing future change orders for additional funding and/or time extensions; and authorizing certain future appropriations.



16-104 - 2R. An ordinance authorizing a contract with NorthWest Communities Development Corporation for the administration of a home repair program for low and moderate income homeowners utilizing 2016-17 Community Development Block Grant (CDBG) funds in a total amount not to exceed $100,000.00.



16-105 - 2R. An ordinance authorizing execution of a supplemental agreement for highway/rail grade crossing safety improvements with the Missouri Highways and Transportation Commission and the Kansas City Southern Railway Company where Crackerneck Road intersects with the railroad tracks at a point known as USDOT #293 600K.



16-106 - 2R. An ordinance finding, determining and declaring the necessity of acquiring public right-of-way and temporary construction and grading easements for the Crysler Complete Streets Project (No. 70110402); authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



16-107 - 2R. An ordinance authorizing a contract With Truman Heritage Habitat for Humanity for the administration of a home repair program for low and moderate income homeowners utilizing 2016-17 Community Development Block Grant (CDBG) funds in an amount not to exceed $100,000.00.



16-108 - 2R. An ordinance authorizing a contract with Truman Heritage Habitat for Humanity (THHFH) as a qualifying community housing development organization, for the development of affordable housing, utilizing HOME Program funds in an amount not to exceed $161,268.00.



16-109 - 2R. An ordinance amending Ordinance No. 18555 to add an addendum changing the location of the community solar farm, changing the equipment being installed in the solar farm, and changing the commercial operating date.



16-110 - 2R. An ordinance approving a Special Use Permit to operate a men’s alcohol/drug abuse recovery center at 11330 E. Truman Road in Independence, Jackson County, Missouri. [Postponed to 11/7/2016 Council Meeting.]



16-111 - 2R. An ordinance approving a Special Use Permit to operate a used vehicle sales lot at 3306 Blue Ridge Boulevard in Independence, Jackson County, Missouri.[Postponed to 11/7/2016 Council Meeting.]
