CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Council action is recommended to issue a purchase order in the amount of $84,980.62 to Kenton Brothers Inc for Access Control & Security upgrades for the Water Department Courtney Bend Plant.



2.

Approval is recommended on the certification of the August 2, 2016 election results, from the Jackson County Board of Election Commissioners.



3.

Council action is requested to issue Change Order No. 1 to Purchase Order 144168, in the amount of $40,723.24, to General Electric for additional work to the Blue Valley Steam Units #3 excitation system for the Power & Light Department. If approved, the new purchase order total will be $71,763.24.



4.

Council action is requested on the application received from Jay Mavdi 1, LLC, to transfer the existing Intoxicating Liquor in the Original Package, Sunday Sales License and Liquor Tasting Licenses for Crown Liquor #3 located at 3900 S. Noland Road.  The applicant is the new owner of this convenience store.



5.

Council action is recommended to enter into price agreement (376-16) with John Bardgett & Associates for the providing of Lobbying Services. This is a one-year agreement with one, one-year renewal option. Expenditures will not exceed budgeted amounts.



6.

Council action is requested on the application from Wadsworth Old Chicago, Inc., for a Restaurant Bar Intoxicating Liquor by Drink License and Sunday Sales License for Old Chicago Pizza & Taproom located at 4661 S. Cochise Court.



7.

Council action is requested to issue a purchase order to Power Engineers, in the amount of $104,320.00, for the outstanding Cityworks development needs for the Service Center at Power & Light.



8.

Council action is requested to issue a purchase order to The Wilson Group in the amount of $127,170.31 for renovations to Fire Station 5 for the Fire Department.



9.

Council action is requested to issue a purchase order to JCI Industries in the amount of $137,534 to replace the basin covers at the Rock Creek Wastewater Treatment for the Water Pollution Control Department.  Expenditures will not exceed budgeted amounts.



10.

Council action is requested to enter into a price agreement (113-16) with Fletcher-Reinhardt for steel and aluminum poles for the period of September 7, 2016 through August 31, 2017. At the sole option of the City, the agreement may be renewed for four, one-year periods. Expenditures will not exceed budgeted amounts.




Resolutions:

16-766 - A resolution of the City Council of Independence in support of an application to conduct condition assessments for the Vaile Victorian Mansion and the Bingham-Waggoner Estate.



16-767 - A resolution authorizing the affirmative assent of the City of Independence on the question of whether Little Blue Valley Sewer District should issue revenue bonds payable from revenues to be derived from the operation of the Little Blue Valley Sewer System in an amount not to exceed $20,000,000.00 for the purpose of improving, extending or rehabilitating The Little Blue Valley Sewer District System including, but not limited to advanced air emissions controls for the Atherton Wastewater Treatment Facilities.



16-768 - A resolution affirming the Mayor’s appointments to the Mayor’s Advisory Commission on the Visual Arts.




ORDINANCES

16-080 - 2R. An ordinance authorizing acceptance of the 2016 Combat Drug Prevention Cooperative Agreement, and related documents, with Jackson County Combat, for a grant award in the amount of $85,000.00; making the necessary appropriations; authorizing future change orders for additional funding and/or time extensions; and authorizing certain future appropriations.



16-081 - 2R. An ordinance approving an amendment to the 2016-2017 Annual Action Plan for the CDBG and HOME Programs, authorizing a revised application to the Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG) Program Year 42 and the HOME Investment Partnerships Act (HOME) Program Year 22; amending Ordinance No. 18572 to reflect the change; and making the necessary appropriations.



16-082 - 2R. An ordinance finding, determining and declaring the necessity of acquiring real property for the construction of an electrical substation; authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



16-083 - 2R. An ordinance approving the Petition to establish the Marketplace Community Improvement District, establishing the District, and making findings and authorizing actions related to establishment of the District.



16-084 - 2R. An ordinance amending the Zoning District Map as to tracts of ground located at 1515 W. Truman Road from District C-2 (General Commercial) to District C-3 (Service Commercial) in Independence, Jackson County, Missouri.



16-085 - 2R. An ordinance amending the Unified Development Ordinance, Chapter 14, of the Independence City Code.



16-086 - 2R. An ordinance amending Chapter 4, “Building, Plumbing and Electrical Installations”, by adding a new Article 15, “Rental Ready Program”, to Chapter 4 of the City Code, pertaining to business licensing and inspection requirements for rental properties to be effective January 1, 2017. [Motion made to substitute language to allow for an effective date of June 1, 2017.]  



16-087 - 2R. An ordinance authorizing the execution of a Mutual Aid Agreement with the City of Liberty, Missouri.



16-088 - 2R. An ordinance amending Ordinance No. 18596 to transfer unencumbered appropriations from the Health Department Operating Budget to the Community Development Department Operating Budget in the amount of seven hundred eighty-three thousand five hundred and NO/00 dollars ($783,500.00).

An ordinance authorizing acceptance of a grant in the amount of $260,000.00 from the Missouri Department of Transportation for reimbursement of overtime for the Police Department for DWI enforcement, sobriety checkpoints and youth alcohol liquor compliance checks from October 1, 2016, to September 30, 2017; authorizing future change orders and/or time extensions for the same project and making the necessary appropriations.

16-513 - 1R. An ordinance amending Ordinance No. 18585, by adding the acquisition of real property on one (1) parcel related to the M-78 Highway and Truman Road Intersection Improvement project (Project No. 70111307), in order to acquire land via fee simple taking for the project and declaring an emergency.

The City Clerk has received notification that the City Manager has accepted a donation from Frances Sharp in the amount of $40.00, for the Fire Department. These funds will be used to purchase equipment for the Fire Department.



2.

The City Council is expected to convene in an Executive Session at 5:15 pm, Tuesday, September 6, 2016, in Conference Room A, on matters of Litigation, as permitted by Sec. 610.021(1) RSMo.; and Labor Negotiations, as permitted by Section 610.021 (9) RSMo.
