CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Approval is recommended to enter into a price agreement (302-16) with Orrick and Erskine, LLP for land acquisition services for the Public Works Department, for the period  May 1, 2016 through April 30, 2017, with two, one-year renewal options.  Expenditures will not exceed budgeted amounts.



2.

Approval is recommended to enter into a price agreement (343-16) with Phillips Paving for asphalt trails for the Parks and Recreation Department for the period May 1, 2016, through April 30, 2017 with two, one-year  renewal options. Expenditures will not exceed budgeted amounts.



3.

Council action is requested on the application from Los Cabos Independence, LLC for a Restaurant Bar Intoxicating Liquor by Drink License and Sunday Sales License for Los Cabos Mexican Grill & Cantina located at 18201 E. Bass Pro Drive.



4.

Council action is requested on the application received from McKeever Enterprises, Inc., to transfer the existing Intoxicating Liquor in the Original Package, Sunday Sales and Liquor Tasting Licenses for a Price Chopper located at 2301 S. Sterling Ave.  The applicant is the new owner of this grocery store.



5.

Approval is recommended to amend the Employment Agreement with City Manager John Pinch.



6.

Approval is recommended to amend the Schedule of Fees for the City of Independence effective July 1, 2016.

16-715 - A resolution affirming Councilmember appointment of John W. Eppert III to the Independence Park Commission for the City of Independence, Missouri.



16-716 - A resolution appointing David R. Baker as an Advisory Member of the Human Relations Commission of the City of Independence, Missouri.



16-717 - A resolution appointing Monica Kettenhofen as a member of the Mayor’s Advisory Commission on the Visual Arts of the City of Independence, Missouri.

ORDINANCES

16-022 - 2R. An ordinance authorizing a contract with the firm of Superior Bowen Asphalt for the 2016 Street Improvements Program, for an amount not to exceed $6,284,396.50; authorizing administrative approval of change orders not to exceed $250,000.00 and/or time extensions; and making the necessary appropriations.



16-023 - 2R. An ordinance authorizing execution of a contract with the Independence Council for Economic Development for the development of the iNTech Accelerator and Tech Growth Program in support of early stage, technology-oriented business development utilizing CDBG Funds, in an amount not to exceed $75,000.00; amendment of the 2015 CDBG Annual Action Plan; and making the corresponding appropriations.



16-024 - 2R. An ordinance amending the Zoning District Map as to a tract of ground located at 15505 E. US 24 Highway from District C-2 (General Commercial) and District R-6 (Single-Family Residential) to District C-2 (General Commercial) in Independence, Jackson County, Missouri.

16-016 - 1R. An ordinance authorizing a contract with the firm of TRS Range Services for the Police Firing Range Renovation project, in an amount not to exceed $545,340.00; and authorizing future minor change orders for an amount not to exceed $10,000.00.



16-025 - 1R. An ordinance authorizing acceptance of the 2016 Midwest High Intensity Drug Trafficking Area (HIDTA) Memorandum of Understanding (MOU) for the Investigative Support Center Initiative, and related documents, with the Kansas Bureau of Investigation, for a grant award in the amount of $146,166.00; making the necessary appropriations; authorizing future change orders for additional funding and/or time extensions; and authorizing certain future appropriations.

An ordinance approving the 2016-2017 Annual Action Plan for the CDBG and HOME Programs, authorizing applications to the Department of Housing And Urban Development (HUD) for the Community Development Block Grant (CDBG) Program Year 42 and the Home Investment Partnerships Act (HOME) Program Year 22; authorizing execution of a written agreement and acceptance of CDBG and HOME Program Funds under the Housing and Community Development Act of 1974; and making the necessary appropriations.

An ordinance authorizing the City Manager to approve a New Rate Schedule: Schedule CSP-1, Community Solar Program Service, which includes the Community Solar Program Agreement (contract); with any costs payable only from the revenues of the Power and Light Operations and not from any tax revenues or general revenues.

16-037 - 1R. An ordinance amending Article 1 “Public Utility Taxes” of Chapter 16 of the City Code and directing the City Manager to provide notification to video service providers as required by section 67.2689.4 of the Missouri Revised Statutes.



16-502 - 1R. An ordinance increasing appropriations in the amount of $922,068.47 in the Operating and Capital Budgets for various departments and capital projects. In addition, this Ordinance transfers appropriations in the amount of $13,000.00 in the Capital Budget for the Storm Water Sales Tax Fund, $1,631,868.41 in the Capital Budget for the Power and Light Fund and $400,000.00 in the Capital Budget in the Sanitary Sewer Fund and making other budget adjustments as necessary for the City of Independence, Missouri, for the Fiscal Year July 1, 2015, through June 30, 2016.  Appropriation ordinances may receive two readings and be voted on at the same meeting.

The City Council is expected to convene in an Executive Session at 5:15 p.m., on Monday, April 4, 2016, in Conference Room A, on matters of Personnel, as permitted by Section 610.021(3) RSMo.

The City Clerk has received notification that the City Manager has accepted a grant from the Missouri Highways and Transportation Commission in the amount of $1,500.00, for the Police Department. These funds will be used to reimburse police officers for overtime worked while enforcing traffic laws pertaining to speed and aggressive driving, DWI, seat belt and child safety restraint.
