PUBLIC HEARING

A public hearing on proposed amendments to Chapter 14 of the City Code, Unified Development Ordinance.  Full Public Hearing.  Case # 14-175-02. [Bill No. 14-041]

Proposed amendments include the following: 1) Revise Use Table 301-1 for 'Light equipment sales/rental (outdoor)' allowing such use as either a conditional or special use; 2) Amend Section 14-409 'Vehicles/Equipment Sales' for certain minimum conditions as a conditional or special use; 3) To Sections 14-504-12 and 14-504-13, correct reference numbers in certain parts of the sign tables.





CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Item No. 1 - Approval is recommended to enter into a price agreement (302-14) with Smith & Smith Appraisal Company for land acquisition services for the Public Works Department, for the period May 6, 2014 through April 30, 2015, with two, one-year renewal options.  Expenditures will not exceed budgeted amounts.

Item No. 2 - Approval is recommended to issue a purchase order, in the amount of $93,500.00, to Sega, Inc. for engineering services for the transformer installation project at Substation J for the Power & Light Department.

Item No. 3 - Approval is recommended to enter into a price agreements (180-14) with HD Supply, Wesco, Fletcher Reinhardt, Kriz Davis and Graybar for Utility Hardware for the Power & Light Department for the period of July 1, 2014 through June 30, 2015, with four, one-year renewal options. Expenditures will not exceed budgeted amounts.




Resolutions:

14-723 - A resolution recognizing Charlotte Olejko, Parks Horticulturalist, in the Parks & Recreation Department, as the Employee of the Month for May, 2014.



14-724 - A resolution reappointing Councilmember Chris Whiting to the City Judicial Commission of the City of Independence, Missouri.



14-725 - A resolution appointing Eileen Weir to serve as City Representative on the Board of Directors of the Independence Economic Development Council through June 30, 2015.



14-726 - A resolution affirming the appointments of Jeremy Povenmire and Jeff Benson to the Public Safety Sales Tax Oversight Committee for the City of Independence, Missouri.



14-727 - A resolution appointing Councilmember Karen DeLuccie to the License Surcharge Annual Review Committee for the City of Independence, Missouri.



14-728 - A resolution appointing Councilmember Chris Whiting to continue to serve, along with Mayor Eileen Weir, as Ex-Officio members of the Japanese Sister City Committee.



14-729 - A resolution appointing Councilmember Curt Dougherty and reappointing Councilmembers Marcie Gragg and Chris Whiting to additional terms to the Audit and Finance Committee, under authority of Resolution No. 3338.



14-730 - A resolution appointing Councilmember Scott Roberson and reappointing Councilmember Chris Whiting and Mayor Eileen Weir to the Employee Advisory Committee for the City of Independence, Missouri.



14-731 - A resolution appointing Jack Cardwell to the Land Trust of Jackson County, Missouri.



14-732 - A resolution appointing Mayor Eileen Weir, Ex-Officio Member, to chair the Independence Harry S Truman Award Commission.



14-733 - A resolution allocating Council Goals funds in the amount of $10,000.00 for Regional Transit Studies by the Kansas City Area Transportation Authority (KCATA).  Council divided into two separate actions at the meeting.  Both passed.




ORDINANCES

14-030 - 2R. An ordinance authorizing a “Contract for License of Independence Square Public Area for Santa-Cali-Gon Fair” with the Independence Chamber of Commerce, in connection with the Santa-Cali-Gon Fair from August 28 through September 1, 2014. [At the April 21, 2014 Council meeting, consideration of this ordinance was postponed for staff to provide further information and for Council discussion at a Study Session held on April 30th.] Amended at the meeting, adding an addendum to the contract on payment of electric utility expenses.



14-034 - 2R. An ordinance authorizing execution of a contract with Integral Construction Services for renovation of the Roger T. Sermon Center locker rooms in an amount not to exceed $81,504.



14-035 - 2R. An ordinance authorizing execution of a contract with Brandy Electric for installation and construction of ballfield lighting at Mill Creek Park in an amount not to exceed $288,000. 




14-036 - 2R. An ordinance authorizing acceptance of grant funding from the Land and Water Conservation Fund for the development of an inclusive playground in McCoy Park in the amount of $75,000 through an agreement with the Missouri Department of Natural Resources; and making the necessary appropriations.



14-037 - 2R. An ordinance approving the 2014-15 Annual Action Plan for the CDBG and HOME programs, authorizing applications to the Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG) Program Year 40 and the HOME Investment Partnerships Act (HOME) Program Year 20; authorizing execution of a written agreement and acceptance of CDBG and HOME program funds under the Housing and Community Development Act of 1974; and making the necessary appropriations.



14-038 - 2R. An ordinance authorizing execution of a contract with the firm of Brotke Well and Pump to drill and construct Well No. 25 at the Courtney Bend Water Plant for the full sum of $364,061.00; authorizing future minor change orders in an amount not to exceed $36,406.00; and/or time extensions; and making the necessary appropriations.



14-039 - 2R. An ordinance authorizing execution of Amendment #1 to the Border Customer Agreement between the City of Independence and Kansas City Power & Light Company, providing for the sale and purchase of energy for certain customers of both parties that are located along the Independence corporate limits.

14-046 - 1R. An ordinance authorizing a contract with Imperial Construction, Inc., for the Central Police Building Renovation project, in an amount not to exceed $932,773.00; and authorizing minor change orders for an amount not to exceed $93,277.00 and/or time extensions.

INFORMATION ONLY:
1.

Item No. 1. The City Clerk has received notification that the City Manager has accepted a grant from the Missouri Highways and Transportation Commission in the amount of $6,000.00, for the Police Department, for the period of May 19, 2014 through June 1, 2014.  These funds will be used to reimburse overtime worked by police officers while conducting aggressive driving enforcement activities during upcoming holidays.

Item No. 2. The City Clerk has received notification that the City Manager has accepted a grant from the Missouri Department of Health and Senior Services in an amount not to exceed $1,800.00, for the Health Department, for the period of May 15, 2014 through September 15, 2014.  These funds will pay for no more than 20 initial inspections at Summer Food Service Program meal production and meal service sites at a fixed rate.
