PUBLIC HEARING

CONSENT AGENDA
Reports and Recommendations of the City Manager
1.

Approval is recommended to enter into price agreements with HD Supply, Ferguson Enterprises and Schulte Supply (102-13) for ductile iron pipe and fittings for the period of April 2, 2013, through March 31, 2014. Expenditures will not exceed budgeted amounts.



2.

Approval is recommended to issue Change Order 1 to Purchase Order 136959, in the amount of $49,500.00, to Corporate Risk Solutions, Inc. for additional consulting services. If approved, the new PO total will be $99,500.00.



3.

Approval is recommended to enter into a price agreement (174-13) with Ed M. Feld for turnout gear for the Fire Department for the period of April 1, 2013, through March 31, 2014. This is a one-year agreement with one, one-year renewal option. Expenditures will not exceed budgeted amounts.  



4.

Approval is recommended to issue a purchase order, in the amount of $489,071.00, to Kenton Brothers, Inc., for an improved security system for the Power & Light Department.




Resolutions:

13-715 - A resolution recognizing Robin Bogart, Fleet Control Data Technician, in the Power and Light Department, as the Employee of the Month for April, 2013.



13-716 - A resolution reappointing Thomas Hayward as a regular member of the Board of Building and Engineering Appeals for the City of Independence, Missouri.



13-717 - A resolution reappointing Hedda Sutherland and appointing Gabrielle Collins to the Citizens With Disabilities Advisory Board for the City of Independence.



13-718 - A resolution reappointing Cody Fann and appointing Diane Reuter as members of the Heritage Commission of the City of Independence, Missouri.



13-719 - A resolution appointing Mohamed Ali Nur as a member of the Human Relations Commission of the City of Independence, Missouri.



13-720 - A resolution encouraging the state legislature to participate in the expansion of Medicaid in Missouri.




ORDINANCES

13-033 - 2R. An ordinance authorizing acceptance of the 2013 Midwest High Intensity Drug Trafficking Area (HIDTA) Memorandum of Understanding for the Kansas City/Overland Park DEA Task Force, and related documents, with the Kansas Bureau of Investigation, for a grant award in the amount of $67,893.12.00; making the necessary appropriations; authorizing future change orders for additional funding and/or time extensions; and authorizing certain future appropriations.



13-034 - 2R. An ordinance establishing that the City of Independence will maintain the 9.08% rate for the Business License Tax on the gross receipts of KCP&L through the recently approved Missouri Public Service Commission 9.64% rate increase.



13-035 - 2R. An ordinance authorizing a contract with the City of Lake Tapawingo, Missouri, for the City of Independence, Missouri, to supply water to Lake Tapawingo.



13-036 - 2R. An ordinance authorizing a contract with Phillips Grading and Construction for the Bly Road bridge improvements project for an amount not to exceed $1,408,609.20, authorizing minor change orders for an amount not to exceed $140,800.00 and/or time extensions, and making the necessary appropriations. 



13-037 - 2R. An ordinance authorizing an on-system bridge replacement and rehabilitation supplemental agreement with the Missouri Highways and Transportation Commission for the 39th Street bridge over the Little Blue River project.



13-038 - 2R. An ordinance authorizing a “Contract for license of Independence Square public area for Santa-Cali-Gon Fair” with the Independence Chamber of Commerce, in connection with the Santa-Cali-Gon Fair from August 29 through September 2, 2013.



13-039 - 2R. An ordinance authorizing a contract with Linaweaver Construction for the Rock Creek Segment 3 Sewer Capacity Improvements project for an amount not to exceed $1,575,644.25 and authorizing future minor change orders for an amount not to exceed $157,000.00 and/or time extensions.



13-042 - 2R. An ordinance authorizing a contract with Public Water Supply District No. 16 of Jackson County, Missouri, for the City Of Independence, Missouri, to supply water to Public Water Supply District No. 16 of Jackson County, Missouri.



13-043 - 2R. An ordinance approving the Amended Blue Ridge Crossing East Tax Increment Financing Plan and approving the Amended and Restated Redevelopment Agreement to implement the Amended Redevelopment Plan.

An ordinance finding, determining and declaring the necessity of acquiring General Utility Easements and Temporary Construction and Grading Easements for the 2011 Neighborhood Storm Drainage Improvements, Project No. 70131105; authorizing the negotiation and eminent domain proceedings if necessary; approving the plans and specifications for the project; authorizing the use of experts as needed; authorizing and directing the execution of documents and the payment of funds to property owners or others holding property rights, in conjunction with the project.



13-046 - 1R. An ordinance authorizing execution of a Service and Billing Agreement with the City of Blue Springs, Missouri, for the City to perform billing, collecting, and accounting for certain Blue Springs’ Sewer Service customers.  



13-047 - 1R. An ordinance authorizing a contract with the City of Blue Springs, Missouri, for the City Of Independence, Missouri, to supply water to the City of Blue Springs, Missouri.



13-048 - 1R. An ordinance approving a Cooperative Agreement among the Crackerneck Center Community Improvement District, Crackerneck Country Club, Inc., and the City of Independence, Missouri.



13-049 - 1R. An ordinance authorizing a Transportation Enhancement Program agreement with the Missouri Highways and Transportation Commission for the Truman Road Streetscape Phase 2 project.



INFORMATION ONLY:
1.

The Council is expected to convene in an Executive Session at 5:15 pm, Monday, April 1, 2013, prior to the Council Meeting, in Conference Room A, on matters of Litigation, as permitted by Section 610.021(1), RSMo, and Real Estate, as permitted by Section 610.021(2), RSMo.



2.

The City Clerk has received notification that the City Manager has accepted a grant from the Missouri Highways and Transportation Commission in the amount of $600.00, for the Police Department, for the period of March 15-31, 2013.  These funds will be used to reimburse overtime worked while enforcing traffic laws to enforce the Seat Belt and Child Safety Restraint laws, and of course, speed, aggressive driving and DWI laws.
