17-082 - 1R. An ordinance amending the Zoning District Map as to a tract of ground located at 10407 E. 15th Street S. from District R-12 (Two-Family Residential) to District C-3 (Service Commercial) in Independence, Jackson County, Missouri.
Recommendations:

Commissioner Cindy McClain made a motion to recommend approval of the application.  A second to the motion was made by Commissioner John Goldesberry. The Independence Planning Commission voted as follows:

The motion failed to pass and was forwarded to the City Council for its consideration.  However, some Commissioners did note in their recommendation that they were not concerned with the particular use being proposed in this application, but were concerned with the range of uses that would be allowed with the C-3 zoning designation. At their next meeting, the Commission may have a discussion to determine if exploring the possibility of a new special use category, for the type of use proposed in this application, would be beneficial to the City.

 

Staff recommends denial of this application.

Executive Summary:

Robert Goetz requests to rezone a 4,000 square foot lot, containing a vacant 1,600 square foot commercial building formally used by a plumbing company, from R-12 (Two-Family Residential) to C-3 (Service Commercial). The applicant intends to store and organize lumber there for rentals that he owns.  

Background:

The existing structure, abutting the E. 15th Street S. right-of-way, lies in a neighborhood of one and two-family residences.

In addition to the structure, the property has a deep rear yard and a side yard to the west of the building with a small gravel driveway.  The rear yard is surrounded by a 6 foot tall gated fence.

 

 Planning Commission Action: 

At its June 13, 2017  Planning Commission meeting, the motion for approval failed to pass by a vote of 1-5, after consideration of the following facts:

 

  1. That the rezoning is not  consistent with the review criteria listed in Section 14-701-02 of the City Code;
  2. That a public hearing was held pursuant to a notice duly published according to law, at which time all interested parties were given the full opportunity to be heard;
  3. That rezoning the property from R-12 to C-3 will allow for the applicant to use a commercially designed building for commercial purposes;
  4. That, at the Planning Commission hearing, no residents had questions or concerns about the rezoning application;
  5. That, at the hearing, no petition protesting this application was presented.
