Executive Summary:

This ordinance will replace Article 5 in Chapter 17 of the City Code.  The article addresses requirements for the use and management of City street right-of-way.  
Background:

This ordinance replaces Article 5 of Chapter 17 in the City Code.  The City has street right-of-way that needs management and protection of public safety.  Utility companies, property owners, and contractors have construction activities and manage facilities in the right-of-way. The ordinance provides the requirements for those construction activities and utility services. It is intended to help the city better monitor and regulate telecommunications equipment and poles that are placed in the right-of-way, to the extent allowed by state law. 


Fiscal Impact:

The Right-of-Way Permit fee is proposed to be established based upon a targeted cost recovery of 100 percent of program administration costs. A new Right-of-Way User fee is established through this ordinance; the fee will be reflected in the Schedule of Fees as updated from time to time.
