17-021 - 2R. An ordinance amending Chapter 9 of the “Code of the City of Independence, Missouri”, to provide for the issuance of fireworks stands licenses in 2017, to amend the time for license issuance in future years, and to limit organizations to one application submittal per year.

Staff recommends approval.

Executive Summary:

This Ordinance will allow not-for-profit organizations which were licensed in 2016 to be assured of licensing in 2017, and moves the application process for the following year (2018) to August of 2017. This will allow organizations to confirm they will receive a license prior to ordering stock for the following year. Additionally, each not-for-profit organization will be limited to one application per year.


In December, 2016, Ordinance No. 18693 was passed to increase the number of fireworks stand licenses issued to not-for-profit organizations from 12 to a total of 16.  This Ordinance also eliminated the practice of grandfathering licenses to organizations which had received one of the 12 licenses in 2016.


When notified of the change, several not-for-profit organizations notified the City Council they had already committed a substantial amount of money to purchasing fireworks for sale the following year, assuming their fireworks stand license would be renewed in accordance with the practice at the time.


In order to allow these organizations to avoid financial hardship for 2017, the timeline for random selection of organizations to receive licenses in future years is being changed.  For 2017 licenses, the organizations which had received one of the 12 licenses in 2016 will receive priority. For future years’ licensing, applications will be taken in August for licenses for the following year. The change will begin with applications being taken in August 2017 for sales in July 2018.


This will allow organizations the opportunity to confirm their fireworks stand license prior to ordering merchandise and committing funds for the following year. To ensure fairness in the random drawing for licenses, each not-for-profit organization will be limited to one application each year.
