Agenda Title:

17-014 - 1R. An ordinance authorizing execution of a contract for the sale of real estate designated as East Hollywood Lots 132 & 133, addressed as 9807 E. 35th Terrace, and commonly known as Pitcher Greenspace; in exchange for payment of $5,000.00 and authorizing all actions necessary to consummate said sale.
Recommendations:

It is the recommendation of the Public Works Department and the Parks Department that this ordinance be approved.
Executive Summary:

The ordinance authorizes the sale of property that was previously approved as surplus by the City Council. The only bidder, Christopher E. Richer, is an adjacent property owner who bid the minimum offer of $5,000. 



Background:

The City acquired Lot 132 and Lot 133 of East Hollywood Addition subdivision on March 6, 1958, as part of a land purchase for a proposed water treatment facility.  The treatment facility was never built and the two lots were transferred to the Parks Department for the creation of a neighborhood park.  Since that time the lots have remained open as a green space maintained by parks maintenance staff.

 

In June of 2016 a neighboring resident approached the City declaring an interest in purchasing the property for private use.  Staff from Public Works and Parks worked together to obtain an appraisal of the land value, and to make a determination on if the properties served a public use or could be surplused.  It was the determination of the Director of the Park, Recreation and Tourism Department, that this land could be listed as surplus and if a valid offer was received the property could be transferred to private ownership. 

 

On December 5, 2016, the City Council approved an ordinance declaring the property surplus, granting authority to sell, and creating a minimum offer amount for the parcels of five thousand dollars ($5,000.00).  The property was then advertised as surplus and all interested parties were given until Thursday, January 27, 2017, at 2 p.m. to remit bids to the City Clerk of Independence. 

 

One bid was received by the City Clerk, with the bid matching the minimum offer required. 



Fiscal Impact:

The City will receive $5,000 to be deposited into the General Fund.
