19-016 - 2R. An ordinance vacating a portion of two (2) utility easements located within Lot 77, Valley Brooke 4th Plat, and Lot 33, Valley Brooke 1st Plat – Lots 1-33 and resurvey of Hidden Valley Acres, Lots 23-24, a subdivision in Independence, Jackson County, Missouri, also known as 17909 E. Hidden Valley Road and 18001 E. 31st Terrace.
Approval of the ordinance is recommended.
In support of the Valley Brooke Development, the developer has requested that the City vacate two unused portions of existing General Utility Easements.
In support of the Valley Brooke Development, the developer has requested that the City vacate two unused portions of existing General Utility Easement. One General Utility Easement was granted by Valley Brooke to the City of Independence on January 20, 2005, and recorded as Document No. 2005I0005290 in Book 85 at Page 7 at the Jackson County Courthouse Recorder of Deeds in Independence, Missouri. One General Utility Easement was granted by Valley Brooke to the City of Independence on August 14, 1992, and recorded as Document No. 1992I1126764 in Book 52 at Page 12 at the Jackson County Courthouse Recorder of Deeds in Independence, Missouri. Vacation will allow for full development of the property. Plans to replat these properties and add General Utility Easements at the new property lines will be submitted by the developer to the City in accordance with the City’s standard policies and procedures. Improvements will be constructed by the developer and inspected by the City.
No work will be required by this request, and a fee of $300 was collected to offset the cost of processing the Vacation Request.
