Agenda Title:

  1. Council action is requested on the application received from Rise to the Top, LLC for a Place of Amusement Intoxicating Liquor License for Upper 90 Bar and Grill located at 19310 E. 50th Terrace.  This application requires a two-thirds majority vote for approval due to residential property located within three hundred (300) feet of the establishment.

Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code.

Executive Summary:

The applicant is requesting Council approval to sell intoxicating liquor by the drink for consumption on premises seven days a week at the Upper 90 Bar and Grill located in the Epic Sports Lodge at 19310 E. 50th Terrace.  The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code.

Background:

The Club House Bar operated with the Epic Sports Lodge from 2010 until it closed in 2018.  Rise to the Top, LLC intends to open a new establishment called Upper 90 Bar and Grill in the same space within Epic Sports Lodge offering the same amenities as the former Club House Bar.

 

Upper 90 Bar and Grill will occupy approximately 1,500 square feet with an approximately 2,100 square foot outdoor patio surrounded by a 6 foot wrought iron fence.  Upper 90 will provide beer, wine, liquor, and food items for sale seven days a week.  Security cameras are in place, and trained personnel will patrol the bar and lodge area to assure all laws are enforced.

 

The proposed premise is within 300 feet of residential property, so this application requires a two-thirds majority vote for approval.

 

The proposed business is a corporation and has appointed Mr. Michael Keithley as Managing Officer for purposes of this liquor license.  Mr. Keithley is not active in other licenses issued by the Missouri Liquor Control.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Mr. Keithley revealed he meets the requirements of the Alcoholic Beverages code.

 

Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
