18-510 - 1R. An ordinance authorizing and directing the City Manager to execute a certain Public Use License Agreement and Declaration of Blight Agreement between said City and the Noland Road Community Improvement District to allow for the installation of various public improvements as may be approved by the City from time to time, on or within the public right-of-way along the Noland Road Corridor; and declaring an emergency.
Approval of the ordinance is recommended.
The City is in receipt of a request from the Noland Road Community Improvement District, seeking permission to install various public improvements as may be approved by the City from time to time, on or within the public right-of-way along the Noland Road corridor as defined in the Agreement.
The Noland Road Community Improvement District, (the “District”) and the City entered into an Intergovernmental Cooperative Agreement (“Cooperative Agreement”) on March 20, 2015. The Cooperative Agreement set forth general provisions for the District and the City to work together to implement the various Capital Improvements to be undertaken by the District within the Noland Road Corridor, both within the public right-of-way and on private property. The District has identified certain Capital Improvement Projects which require access to the public right-of-way. Capital Improvement Projects of the District require a declaration of blight by the City to allow expenditures of the District funds. The City is in receipt of a request from the District, seeking permission to install various public improvements as may be approved by the City from time to time, on or within the public right-of-way along the Noland Road corridor as defined in the agreement.
The ordinance will enable the administrative approval of projects submitted by the CID (while still subject to City design and construction standards), allowing for a more efficient approval process.
This ordinance is deemed to be of an urgent nature and that its immediate passage is necessary for the preservation of the public peace, property, health, safety and welfare of the residents of the City of Independence and should become effective immediately upon the date of its passage, for that reason immediate action is required in order for the City Council to act on the application to allow initial project construction activity to commence to avoid winter weather issues and that a delay may cause an undue hardship on the construction activity.
