18-090 - 2R. An ordinance annexing a “contiguous and compact” area of land consisting of two adjacent tracts, totaling 91.66 acres, located generally south of east Truman Road (State Route FF) and east of South M-7 Highway in unincorporated Jackson County, Missouri, into the corporate limits of the City of Independence, Missouri, and authorizing and directing the City Clerk to do those things necessary to accomplish said action.
Staff recommends approve to annex a contiguous and compact area of land consisting of two adjacent tracts totaling 91.66 acres.
The applicant has requested that the City of Independence annex this property into the corporate limits of the City so that the property owner can have water service. Currently, the property is vacant and is not a part of any incorporated municipality. The property is adjacent to the City Limits line along Truman Road.
Pursuant to Section 71.012 of the Revised Statutes of Missouri, the voluntary annexation process begins when a petition requesting annexation and signed by all the owners of record of the real property is presented to the City Council. The Council then holds a public hearing open to any interested person after notice has been published in a newspaper of general circulation within the City.
If no objection to the proposed annexation is filed within fourteen days after the public hearing, the Council may annex the territory by ordinance without further action. The ordinance contains an emergency clause that will allow it to become effective immediately following the second reading. The City then must send three certified copies of the ordinance to be filed with the county clerk and one certified copy to be filed with the election authority.
The property is currently vacant. The property owners propose to construct a single family house and desire to have City water service. If annexed into the City, the subject property will be zoned RA (Residential Agriculture) as this zoning district corresponds to the Agriculture (AG) classification the site is zoned in unincorporated Jackson County. The property meets the minimum 3 acre lot size requirement. The construction of the house would be reviewed, permitted and inspected by the City.
Upon annexation, the City will be required to furnish normal municipal services to the area. The area will generate tax revenues for the City.
