Agenda Title:

  1. Council action is requested on the application received from Truman Mart, LLC for an Intoxicating Liquor in Original Package License for Stop & Shop located at 1001 West US 24 Highway.  This application requires a two-third majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.


This application meets the requirements of the City’s Alcoholic Beverage Code.  However, the Parks, Recreation and Tourism Department notes that although the park space within 300 feet of this proposed establishment is green space, there are concerns with alcohol sales at the proposed location due to the large amount of transient population that in the past have frequented that greenspace and McCoy Park with alcohol in their possession.
Executive Summary:

The Council approved a Retailer of Intoxicating Liquor Package License at this location for Beer and Tobacco Outlet in November of 2010, which was issued to Fast Service, LLC.  This applicant, Truman Mart, LLC, plans to build a new facility to south of the existing licensed premise/gas canopy, and then tear down the existing licensed premise.  The existing gas canopy will remain, and this subject application is for the new facility.


The applicant is requesting Council approval to sell intoxicating liquor in the original package seven days a week at the new convenience store which would have gasoline sales.  The applicant has submitted a signed affidavit indicting that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type.    


There are no hospitals, churches, or schools, however there is residentially zoned properties and park property within 300 feet of the proposed premises according to the City’s mapping system.  

The proposed business is a corporation and has appointed Mr. Richard T. Bryant as Managing Officer for purposes of this liquor license.  Mr. Bryant is active in other licenses issued by the City and Missouri Liquor Control.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Mr. Bryant and the other corporate member, revealed they meet the requirements of the Alcoholic Beverages code.
