18-078 - 1R. An ordinance amending Section 18.21.013 of the Independence City Code to allow law enforcement use of all-terrain vehicles on the public streets, including rights-of-way, alleys, sidewalks or other public property and prohibit the use of all-terrain vehicles by the public on public property.

The Police Department recommends approval of this amendment to the City Code.

The Police Department has acquired all-terrain vehicles that may be used for city functions such as traffic control; parks, trails, and other city property patrol; prevention of crime and disorder; locating missing or endangered persons; and/or educational purposes.  As such, it is being recommended that Section 18.21.013 of the Independence City Code be amended to read as follows:

No person shall operate an "All Terrain Vehicle" upon the public streets, including rights-of-way, alleys, or sidewalks, or other public property of the City of Independence, Missouri, except all terrain vehicles owned and operated by a governmental agency for official use.
