Agenda Title:

Council action is requested on the application to transfer the existing Retailer of Intoxicating Liquor Package Liquor License and Sunday Sales License from 24 Highway Thriftway, Inc. to Shabz, LLC. for 24 Highway Market located at 1000 West US 24 Highway. This application requires a two-third majority vote for approval due to residential property being located within three hundred (300) feet of the establishment.
Recommendations:

This application meets the requirements of the City's Alcoholic Beverage Code.  However, the Independence Police Department is recommending that the 24 Highway Market liquor license not be approved.  The reasoning for this recommendation is attached.  
Background:

The Council approved a Retailer of Intoxicating Liquor Package Liquor License and Sunday Sales License to 24 Highway Thriftway, Inc. in December 2009 to M & I Enterprises. In April 2016, the operator reduced the total sales premise area to 3,800 square feet and stated the alcohol sales of the business would account for no more than 30% of their gross annual sales.  

The applicant, Shabz, LLC, intends to purchase this establishment, subject to the transfer of all licenses.  The applicant is requesting Council approval to transfer the existing liquor licenses to sell intoxicating liquor by the package seven days a week. The applicant has submitted a signed affidavit indicting that this location will have alcohol sales that will be less than 90% of their gross sales.    

Shabz, LLC has appointed Shabana Mughal as Managing Officer for purposes of this liquor license.  Ms. Mughal is not active in other licenses issued by the City or by the Missouri Division of Alcohol and Tobacco Control. The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Ms. Mughal revealed she does not have any violations that would disqualify her from obtaining a liquor license from the City. 

A similar application was reviewed by City Council at its October 2, 2017, meeting.  That application failed to be approved by the City Council.
