Executive Summary:

This ordinance authorizes the City Manager to execute an amended development agreement between the City of Independence and Little Richard’s Family Restaurant, Inc.  The original development agreement was approved by the City Council in December 2015. 

Background:

In September 2015, the City issued a Request for Proposal (RFP) to convey the 0.75 acre site that was no longer needed by the City as part of the Salisbury Hills detention basin project.  Little Richards Family Restaurant, Inc was the sole respondent to the RFP. 

 

On December 7, 2015, the City approved Ordinance No. 18529 to enter into a development agreement with Little Richard’s Family Restaurant to convey the property; the development agreement was executed by both parties and the property was conveyed on February 24, 2016. 

 

After the conveyance of the property, Little Richard’s was working to acquire excess right-of-way property from the State of Missouri.  Due to unforeseen circumstances, the process took significantly longer than anticipated and a one-year extension to the original agreement was granted in accordance with the underlying ordinance. 

 

The amended agreement modifies the required improvements, when the improvements are to be completed, and adds the legal description for the right-of-way property acquired from the State of Missouri to the agreement.  All other terms of the original agreement remain in place.
