Executive Summary:

This ordinance will approve the Petition to Establish the New Town at Harmony Community Improvement District and create the District.

On March 28, 2018, the City Clerk received the Amended Petition to Establish the New Town at Harmony Community Improvement District (the “Petition”). This was submitted as an amended petition because the first version of the petition that was submitted to the City Clerk did not have the correct number of signature pages. The City Clerk, in cooperation with special legal counsel for the City, reviewed the Petition and determined that the petition is complete and can be considered by the Council.

The creation of the CID district must be by ordinance pursuant to the CID Act.

Fiscal Impact:

The CID will impose special assessments and a sales tax in the maximum amount of 1%. The revenues that are generated from these funding sources will be used to reimburse Developer for costs associated with the construction of public improvements that serve the area, and for special services that will be provided by the CID, as further explained in the Gilmore & Bell memorandum. The applicant does not request the appropriation of any City revenues to or for the CID.
