Agenda Title:

18-502 - 1R. An ordinance approving a final plat of RB Commercial Center at 20400 E. US 40 Highway, in Independence, Jackson County, Missouri; and declaring an emergency.

The motion passed with a recommendation for approval to be forwarded to the City Council for consideration.  Staff concurs with the recommendation of the Planning Commission.

Executive Summary:

RB Property Management, LLC requests Final Plat approval of RB Commercial Center, located at 20400 E. US 40 Highway.

Background:

RB Properties seeks to divide this 15.7 acres into three lots (and two tracts) ranging in size from 3.74 to 6.75 acres.  All lots will be accessed via a private drive (Tract A) extending north from west bound lanes of US 40 Highway.  A property owner association is being formed to maintain the common drive and keep the taxes paid.  The Little Blue River Sewer District metering station near the middle of site will remain.  Areas of floodplain and a Fourth Order Stream Buffer is situated in the northwest corner of the property.

Storm Water:  According to the Public Works Department, as this site lies within 1,200 feet of the Little Blue River, it’s possible to pay fees in lieu of stormwater detention.  As the applicant plans to utilize this option, no on-site detention is being provided.

Access and Right-of-Way:  Access will be provided via a central private drive (Tract A) onto the west bound lanes of US 40 Highway, with no direct access onto US 40 Highway.  The Missouri Department of Transportation (MoDOT) noted that it has no objection to the proposed drive connection to US 40 Highway but reserves the right to require a dedicated right turn lane in the future, depending on the use of the two front parcels.

Public Utilities:  Sanitary sewer service will be provided via existing facilities on the site which are part of the Little Blue Valley Sewer District.  A new water main is being extended north from E. US 40 Highway to provide water service and fire protection.

Emergency Justification:

The final plat is deemed to be emergency ordinances to expedite the development process.
