The motion passed and such application is forwarded to the City Council for its consideration. Staff recommends approval of this application.

Executive Summary:

The City seeks rezoning approval for several properties on E. Lexington Avenue, between S. Strode Avenue and S. Wilson Avenue to bring the zoning in conformance with the actual use of the lots.

Background:

City staff became aware of this residential area which is zoned I-1 (Industrial), when one of the property owners tried to sell his single family home on E. Lexington.  He approached the City stating that potential buyers were having trouble finding a mortgage company willing to finance the sale as the house could not be rebuilt if destroyed greater than 50% of its market value.  After reviewing zoning of the immediate area, it was decided that this property, along with seven other lots along this segment of E. Lexington, were prime candidates for a City initiated rezoning.  Below is a table that lists the property address on E. Lexington and its current use.

The change of the zoning for these properties will resolve issues relating to obtaining a real estate loan, rebuilding the structures in case of catastrophe, and making improvements to the properties.

 

For the most part, zoning in the area has remained unchanged since the mid-1960’s, with single and two-family residential properties lining this segment of E. Lexington.  In Independence, it was common practice to have industrial zoned properties adjacent to rail lines with the intent to promote economic development.  With the exception of the City’s Open Space, all of the subject lots are designated for Low/Medium Density Residential Uses (3.0 – 7.0 d/u acre). There are no neighborhood or sub-area plans for the site.  

 

Planning Commission Action:  At its July 25, 2017 Planning Commission meeting, the motion for approval passed, after consideration of the following facts:

 

  1. That the rezoning is consistent with the review criteria listed in Section 14-701-02 of the City Code.
  2. That a public hearing was held pursuant to a notice duly published according to law, at which time all interested parties were given the full opportunity to be heard.
  3. That in addition to the City Open Space, the subject area contains four single family homes, and three two-family dwellings.
  4. That this rezoning to R-12 would make the property’s zoning conform to its current use for single and two family homes.
  5. That, at the Planning Commission hearing, two people spoke in favor of the application, no one spoke against the request.
  6. That, at the hearing, no petition protesting this application was presented.
