14-120 - 2R. An ordinance amending the Combined Utility Customer Service Rules and Regulations pertaining to Weather Rules for Discontinuing Service.

Recommendations:

Staff recommends approval of this Ordinance.

Executive Summary:

In 2008 The City adopted certain policies and procedures regarding combined Utility customer service. Those policies and procedures were for the most part, directly structured (in some cases word-for-word) from the Rules and Regulations of the Missouri Public Service Commission (PSC). One difference though, was the temperature guidelines for the restriction of electrical utility shutoffs for non-payment of utility bills. This ordinance will address those differences and bring the City policies in line with the PSC’s on this matter. In addition, these changes will offer a higher level of public safety during times of weather extremes.

Background:

Municipally owned utilities, unlike the investor owned utilities, are not subject to the rules put forth by the PSC. The City has however, modeled much of the City of Independence Combined Utility Customer Service Rules and Regulations directly from those Rules and Regulations of the PSC. This ordinance will bring the City’s practices more in line with those of the PSC’s.
The previous City policy states that the electrical utility service will not be shut off for non-payment when the 24 hour forecast predicts temperatures colder than 20 deg. F. and the PCS rules state a forecast of 32 deg. F. The previous policy also states that the electrical utility service will not be shut off for non-payment when the 24 hour forecast predicts a heat index of greater than 100 deg. F. while the PCS rules state temperatures forecasted in the next 24 hours to be in excess of 95 Deg. F. or a heat index greater than 105 deg. F.
These changes were presented and approved unanimously by the Public Utility Advisory Board on September 18, 2014.
